Counselling Services Disclaimer and Indemnity

1. Third-Party Counselling Services

The MyBrada App (“the App”) facilitates access to counselling services by connecting users with qualified third-party service providers, including but not limited to social workers, counsellors, and related professionals (“Service Providers”). These Service Providers are not employees, agents, or representatives of MyBrada (Pty) Ltd (“the Company”).

2. Limitation of Liability

By using the counselling services made available through the App, the user acknowledges and agrees that the Company merely acts as a facilitator and shall not be held liable for any acts, omissions, advice, outcomes, or services rendered by the third-party Service Providers. The Company makes no warranties, express or implied, as to the quality, effectiveness, safety, legality, or suitability of the counselling services provided.

3. Independent Responsibility of Service Providers

All counselling services are delivered at the sole discretion and professional judgment of the relevant Service Provider. Any dispute, claim, injury, damage, or loss arising from or related to the counselling engagement is the sole responsibility of the Service Provider, and the user agrees to hold MyBrada (Pty) Ltd harmless from any and all liabilities, claims, or actions thereof.

4. Indemnity Form Requirement

Prior to the commencement of any counselling session, the user shall be required to sign a formal Indemnity and Consent Form presented by the Service Provider. This form serves to confirm the user’s understanding and acceptance of the terms under which the counselling is provided, and indemnifies the Company from any responsibility or liability arising out of such counselling.

5. Emergency and Referral Services

The MyBrada App provides an emergency Panic Button feature that connects users to referral services for urgent support. While the App does not offer direct medical or psychiatric care, it helps users reach the appropriate emergency services when needed.

6. Include a child protection clause stating

In cases of abuse, neglect, or threats to a child’s safety, we are legally required to act in the child’s best interest, including referring them to appropriate services without parental consent, as per the Children’s Act
